RENTAL AGREEMENT & RELEASE OF LIABILITY

Please read this agreement carefully. By signing below, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions.

• 1. IDENTIFICATION & AGE REQUIREMENTS: Renter must be of legal age (21-25+ depending on vehicle type) and present a valid, government-issued driver's license at time of pickup. Renter affirms that the uploaded license information is accurate and current.
• 2. ASSUMPTION OF RISK: Renter acknowledges that rental of vehicles, boats, RVs, and equipment involves inherent risks including but not limited to: property damage, personal injury, accidents, collisions, mechanical failure, and death. Renter voluntarily assumes all such risks.
• 3. RELEASE OF LIABILITY: Renter hereby releases, waives, discharges, and covenants not to sue Travel DRD, its owners, officers, employees, agents, and affiliates (collectively "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Renter or any property of Renter while using the rental equipment.
• 4. INDEMNIFICATION: Renter agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs (including attorney's fees) that may be incurred due to Renter's use of the rental equipment, whether caused by negligence of Renter or otherwise.
• 5. INSURANCE: Renter must maintain valid automobile insurance (for vehicle rentals) and agrees to be primarily responsible for any damage or loss to the rental equipment. Renter's insurance is primary and Travel DRD's insurance (if any) is secondary.
• 6. DAMAGE RESPONSIBILITY: Renter is fully responsible for all damage to rental equipment during rental period, including but not limited to: collision damage, vandalism, theft, weather damage, mechanical damage caused by misuse, and cleaning fees. Security deposits will be retained to cover damages.
• 7. PERSONAL PROPERTY: Travel DRD is not responsible for any personal property left in or on rental equipment. Renter releases all claims for lost, stolen, or damaged personal items.
• 8. SAFE OPERATION: Renter agrees to operate rental equipment safely, legally, and in accordance with all applicable laws. Renter will not operate equipment while under the influence of alcohol or drugs. Renter will not allow unauthorized persons to operate the equipment.
• 9. AUTHORIZED LOCATIONS: Golf carts: street-legal roads only, no beach driving. Boats: within 10 nautical miles of departure point, no operation after sunset or in adverse weather. Vehicles: no off-road use except on designated trails.
• 10. LATE RETURNS & FEES: Late returns subject to additional daily rental charges. Fees will be automatically charged to the payment method provided. Failure to return equipment may result in theft charges.
• 11. CANCELLATION POLICY: 48-hour cancellation notice required for full refund. Cancellations within 48 hours forfeit deposit. No-shows forfeit entire rental payment.
• 12. FUEL POLICY: Motorized equipment (boats, RVs, vehicles) must be returned with full fuel tank. Failure to do so will result in refueling charges at $7/gallon plus service fee.
• 13. CLEANING FEES: Equipment must be returned in clean condition. Excessive dirt, sand, pet hair, or odors will result in cleaning fees ($50-$200 depending on severity) deducted from security deposit.
• 14. MEDICAL CONDITIONS: Renter certifies that they have no medical conditions that would impair their ability to safely operate the rental equipment. Renter assumes all risk related to pre-existing medical conditions.
• 15. THIRD-PARTY CLAIMS: Renter is responsible for any and all third-party claims arising from use of rental equipment, including bodily injury, property damage, and legal fees.
• 16. SEVERABILITY: If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• 17. GOVERNING LAW: This agreement shall be governed by the laws of the State of Florida. Any disputes shall be resolved in Lee County, Florida.
• 18. ENTIRE AGREEMENT: This agreement constitutes the entire agreement between Renter and Travel DRD and supersedes all prior negotiations, representations, or agreements.
• 19. EMERGENCY CONTACT: Renter authorizes Travel DRD to contact emergency services and agrees to be responsible for any associated costs in the event of accident or injury.
• 20. ACKNOWLEDGMENT: Renter acknowledges that they have carefully read this agreement, fully understand its contents, and sign it freely and voluntarily without any inducement.
